TERMS AND CONDITIONS

These are the standard terms and conditions that apply to Website Design and Development and all other work undertaken by Marvi Digital for its clients under this head. Proceeding with ordering the website ensures your agreement on the following terms and conditions.

REGARDING OUR INABILITY TO COMPLETE THE PROJECT

In certain rare situations, we might not be able to complete the project of the client. In such situations we will not be bound to compensate for any kind of losses suffered by the client. In all such situations full refund will be provided to the client.

WEB HOSTING

On External Servers

1.Server purchased by Marvi Digital

In this case, we buy web hosting from a reputed third party and deliver the entire website to the client along with all the login credentials.

The client is supposed to comply with the terms and conditions of the hosting company. Any dispute between the client and the hosting company will need to be dealt mutually between the client and the hosting company.

2.Server provided by the client

In this case, client already has all the login credentials and access. Our role is to just install the website on the server provided.

On Internal Servers

In cases where Marvi Digital provides the web hosting on servers rented by Marvi Digitals for its use, we assume the responsibility to keep the server up at maximum instances. In case the server goes down, we will be fixing it in minimum duration of time.

Considering the fact that even the best servers go down at some instances, we expect cooperation of the client during the period of downtimes.

ANDROID APP TERMS OF USE

These are the standard terms and conditions that apply to Android app work undertaken by AM Technologies (Marvi Digital) for its clients.

Website Connected App

Unless the app is mentioned as an independent app in the introductory email, the Android app we are providing will only work with the website we have provided. The app is configured to pick data from the website.

Android application

The app we are providing is an android application. IOS versions can be made available separately.

Google Play Review Times

We submit every app to Google Play and google takes time to review the app. Generally it takes 24-36 hours for the app to get approved. But, depending on the circumstances and internal load on Google, review times may be longer.

All we can guarantee that the application will get approved and go live unless the products in the app are violating Google’s terms of use. Products violating Google’s terms of use is an almost unlikely scenario.

Google developer account

We initially publish the app from our google developer account. In case the customer wants to have the app transferred to his/her developer account, we can do it at no additional cost.

In future times, if in case there is any problem in our Google developer account which is hosting the app of the client, we might need to publish fresh app for the client via other Google developer account. We publishing client’s app via our developer account is just a temporary arrangement meant to ease the client during the start of the project. It is suggested to have the app transferred to your own Google developer account after few months of running it from our account.

Maintenance

Maintenance of the app is connected to the maintenance of the website. App picks all data from the website as it is deeply configured into it.

Sample Content

All the content that is provided on the website is sample content sourced from Google. The content is just meant to give website a structure. It will be the responsibility of the client to change the sample content and insert his/her own content. We as a company will not be responsible for any copyright issues arising at later stages.

Neither we nor the client holds any copyright for the design. Marvi Digital can be using the design/parts of design for other clients as per their needs.

Playstore Rankings

We do not guarantee any specific position in play store results for the app. It is totally up to the Google to rank your app on its search results. All apps we prepare adhere to current best practices of search engine optimization. Rankings are generally dependent on the activity in the app. Most of our client’s apps appear on top positions in play store search.

Training and tutorials

Because customer service is an integral part of our business strategy, all of our projects include a one-time detailed training session in order for our clients to better make use of their new web technology. Such training on the product can be repeated maximum 2 times per month.

Our responsibility

Once you have paid us in full for our work, we assume the responsibility that the entire setup created by us will work properly for the period of one year, provided all the terms and conditions are complied with. If in case the setup malfunctions before the period of one year and we are not able to restore it to the version delivered initially or provide an alternative arrangement, refund will be provided to the client based on the time client was able to use the website.

Source code

As per the industry norm, source code of the application cannot be provided.

TRAINING AND TUTORIALS

FREE WEBSITE MAINTENANCE

WEBSITE RESTORATION

In case any mishap happens with the website, we can restore it to the initial version delivered. We can also restore the current backup of the client’s website, if the backup is provided by the client. Such restoration of backups is limited to one instance per week. If more than one such instance happens per week, then the restoration service would become chargeable.

After the period of one year, the restoration service would be applied as per the rules of maintenance service. Maintenance service will be chargeable based on the prevailing rates. There is no obligation on the client to take the maintenance from Marvi Digital after the period of one year. At the same time, Marvi Digital reserves the right to not renew the maintenance service for any particular client.

FREE SUPPORT

Under our 1 year free support policy, we provide 5 days of telephonic support to the client and 1 year of support over email. Support is provided over the features and functionalities that have been provided to the client at the time of delivering the product.

OUR RESPONSIBILITY

NON-DISCLOSURE

We (and any subcontractors we engage) agree that we will not, at any time disclose any of your confidential information to any third party.

OWNERSHIP OF DOMAIN NAMES AND WEB HOSTING

Client is the owner of the domain name and the web hosting for the period it is taken, either from us or from a third party. We will supply to you account credentials for domain name registration and/or web hosting that we purchased on your behalf when you reimburse us for any expenses that we have incurred.
In case the website is hosted on our servers, we do not provide the Cpanel credentials. Client will be responsible for the renewal of web hosting and domain name after the period of one year has passed. We will not be liable for any loss occurring due to expiration of domain name or the files due to non renewal.

COMPLAINCE

Client is responsible for complying with all relevant laws of his state/country. We as a company will not be responsible for any illegal activity/action being conducted via the website that we have designed.

POLICY REGARDING THIRD PARTY SOFTWARE

In some cases, Marvi Digital will install software for the client’s use that has been built by a third party. Examples include WordPress blog software, FCK editor software, themes, shopping carts, photo galleries, etc. In these instances, clients will be subject to the terms and conditions of the third party who owns the software. No ownership rights of any kind are transferred to the client.

In the event some third party software malfunctions/defaults due to reasons limited to the company that owns it, we will not be held responsible for the same. We will be liable to find the alternative so that the client’s website stays unaffected. The alternative may not exactly match with the previous software in terms of design and functionality.

All third party software used by us are licensed/free/GPL Version. If any software/plugin, other than what was delivered initially is installed on the website by the client, then in that case we cannot take any guarantee of the proper functioning of both the website and the software installed under the maintenance that is offered.

GOVERNING LAW

Any dispute arising between AM Technologies and client will be subject to the jurisdiction of Indore district court only.
